§1 Scope

These Terms and Conditions apply to all orders placed with us by consumers and businesses through our online shop https://vip-boost.de. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their commercial or independent professional activity. A business is a natural or legal person or a partnership with legal capacity that, when entering into a legal transaction, acts in the exercise of its commercial or independent professional activity.

§2 Conclusion of Contract

The presentation of the products in the online shop does not constitute a legally binding offer but rather a non-binding online catalog. You can order our products via the cart. By clicking the "Submit order" button, you place a binding order for the goods contained in the cart. The purchase contract is concluded when we confirm your order with an order confirmation by email. During the order process, you also expressly consent to us beginning performance of the service immediately, and you confirm that your right of withdrawal lapses once performance begins. Without this consent, no order can be placed.

§3 Description of Services

We provide professional services in the field of online reputation management, in particular:

• Google reviews (1, 4 and 5 stars)
• Review removal
• Test reviews
• Individual review texts

All reviews are created by real users and comply with the guidelines of the respective platforms.

§4 Prices and Payment Terms

All prices are in euros. Any applicable taxes are shown during checkout by our payment provider. Payment is made via the payment methods we offer (credit card, PayPal, bank transfer). The invoice is created immediately after the order and sent by email.

For orders of 10 reviews or more, we grant the following discounts:

• 10-24 reviews: 5% discount
• 25-49 reviews: 10% discount
• 50-99 reviews: 15% discount
• 100+ reviews: 20% discount

§5 Delivery and Provision of Services

Processing of your order begins after receipt of payment. The reviews are created within 3-7 business days. For larger orders, the processing time may take longer. You will receive regular updates on the progress of your order.

Test reviews are free of charge and can only be ordered once per customer and Google My Business profile.

§6 No Right of Withdrawal

Our services are digital services to improve your online reputation, which begin immediately after your order and are performed within a short time. For such immediately performed digital services, there is no right of withdrawal once performance has begun with your express consent.

Important note: By placing your order, you expressly consent to us beginning performance of the service immediately, and you confirm that your right of withdrawal lapses once performance begins. Without this consent, no order can be placed.

§7 Warranty

We warrant that all reviews are created by real users and comply with the guidelines of the respective platforms. In the event of problems with the reviews created, we offer free rectification.

We do not guarantee the permanent availability of the reviews, as this depends on the guidelines of the respective platforms. As a contractual goodwill measure, however, we grant a free replacement guarantee: should a delivered review subsequently be removed, we will replace it free of charge. A refund after performance has begun is excluded outside of this replacement guarantee.

§8 Liability

We are liable for intent and gross negligence. For slight negligence, we are only liable for damages resulting from injury to life, body or health, as well as for damages resulting from the breach of an essential contractual obligation whose fulfilment makes the proper execution of the contract possible in the first place.

§9 Data Protection

The collection, processing and use of your personal data is carried out exclusively in accordance with the provisions of our privacy policy, which you can view at https://vip-boost.de/datenschutz.

§10 Final Provisions

The law of the State of Delaware, United States applies, excluding the UN Convention on Contracts for the International Sale of Goods, unless mandatory consumer protection provisions of the state in which the consumer has their habitual residence preclude this. The place of performance and jurisdiction is Newark, Delaware, USA, to the extent permitted by law.

Should individual provisions of this contract be or become invalid, the remainder of the contract shall remain valid. The invalid provision shall be replaced by a valid provision whose economic purpose comes closest to that of the invalid provision.
